REGULATION #5000.01    Affiliated and Independent Activity Groups

1.  By signing this Waiver and Release of Liability (Agreement), I waive and release Four Seasons at  Metedeconk Lakes Homeowners Association, Inc., its agents, servants, employees, insurers, successors and  assigns, the Event Organizer and its members (collectively “Event Organizer”) from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including but not limited to claims for personal injury, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence or involvement in the Event.

     This waiver and release is intended to and does release Four Seasons at Metedeconk Lakes Homeowners Association, Inc. and the Event Organizer from any and all liability for damages or injuries on account of or in any way related to or growing out of my negligence, the negligence of third parties and Four Seasons at Metedeconk Lakes Homeowners Association, Inc.’s negligence. This is not intended to release Four Seasons at Metedeconk Lakes Homeowners Association, Inc. from any liability resulting from their gross negligence.

I agree not to institute any claims or legal action against Four Seasons at Metedeconk Lakes Homeowners Association, Inc. and the Event Organizer from any claim released by this Agreement. I further agree that should any claim be made against Four Seasons at Metedeconk Lakes Homeowners Association, Inc. or the Event Organizer, other than as provided for in this Waiver and Release, including but not limited to derivative claims, I will protect, defend and completely indemnity (reimburse) Four Seasons at Metedeconk Lakes Homeowners Association, Inc. and the Event Organizer from any such claim and expenses including attorney’s fees and costs incurred by Four Seasons at Metedeconk Lakes Homeowners Association, Inc. or the Event Organizer in defending themselves or security indemnity hereunder.

2.  I understand that Four Seasons at Metedeconk Lakes Homeowners Association, Inc. and the Event Organizers are not responsible for any lost, stolen, or damaged valuables or property.

3.  I have read the Agreement and understand that by signing the Agreement I have consented to be bound by its terms, including the waiver/release of any legal right I may have to sue Four Seasons at Metedeconk Lakes Homeowners Association, Inc. and the Event Organizer for any costs they incur because a claim or legal action is brought in violation of this Agreement.

            In consideration for my ability to participate in travel and related activities organized by the activity groups of Four Seasons at Metedeconk Lakes Homeowners Association, Inc. (“Association”):

            1.         I understand that this Agreement to Waive and Release Liability (“Agreement”) shall apply to my participation in travel and related activities organized by any Affiliated or Independent Activity Groups.   one, more than one, or all of the following activity groups: Broadway Rhythms, Brooklyn Club, History Club, Garden Club, Italian-American Club, Magic Club, Men’s Club, Photography Club, Opera Club, Shalom Club, Social Committee, Wine Club, and Women’s Association (collectively, “Activity Groups”). 

            2.         I acknowledge that the travel and related activities organized by the Activity Groups (“Activity Group Events”) can include risk of personal injury and other types of injury.  I agree to accept and assume all risk which may arise from my participation in the Activity Group Events.  I am in good health and have no health issues which would prevent or limit my safe participation in the Activity Group Events.    

            3.         I agree to release, waive liability, and covenant not to sue the Association, its agents, managing agent, servants, employees, officers, trustees, insurers, Activity Groups, and members of Activity Groups, and the successors and assigns of each of them (collectively “Association Parties”) from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including, without limitation, claims for personal injury, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence or involvement in the Activity Group Events.

            4.         I agree to waive and release the Association Parties from any and all liability for damages or injuries on account of or in any way related to or growing out of (a) my negligent act or omission, (b) the negligent act or omission of third parties, and (c) the negligent act or omission of the Association Parties or any of them.  This is not intended to release any of the Association Parties from liability resulting from their individual gross negligence.

            5.         I agree not to institute any claims or legal action against the Association Parties for any claim released by this Agreement.  I further agree that should any claim be made against the Association Parties, other than as provided for in this Agreement, including but not limited to derivative claims, I will indemnify, defend and hold harmless the Association Parties, and any of them, from any such claim and expenses including attorney’s fees and costs incurred. 

            6.         I acknowledge and agree that the Association Parties are not responsible for any lost, stolen, or damaged valuables or property.

            7.         I acknowledge that I have read this Agreement and understand that by signing below I have consented to be bound by its terms and that I am waiving and releasing important legal rights.

Regulation 5000.03       ACTIVITY GROUP GUIDELINES

Bus Trips

1. AG’s must update a bus company’s insurance documentation no more than ten days prior to trip.
2. Bus companies must have their own active insurance.
3. AG’s shall add to their trip flyers a request that all trip participants park at the far end of the parking lot, away from the clubhouse.
4. Each participant engaging in an off-site trip (via bus, train, boar or airplane) sponsored by an affiliated or independent activity group must complete a Waiver and Release of Liability Agreement.  See  All bus trips are subject to  Regulation 5000.01  which governs documentation, amount of insurance liability coverage, duration of trip, 3^rd party insurance, and participants.  A trip Release Agreement must be completed by each participant engaging in an overnight trip sponsored by an FSML Activity Group.  See Regulation 5000.01  for complete details.  Group Leaders are to provide the Resident Services Coordinator a list of all trip attendees before the trip, and the actual signed Release Forms.

Capacity of Ballroom

Dinner dance w/Band/DJ will have no more than 170 people in attendance.  Table setup is flexible as long as it maintains the restrictions mandated by the Jackson Fire Department.

Stadium Seating w/stage Capacity depends upon stage set up.  For example:

2 sections, 4 feet from wall  = 280

4 sections, 8 feet from wall  = 260

6 sections, 8 feet from wall) = 240; full stage (9 sections, 12 feet from wall) = 220.  Aerobics room chairs are used above 220.

Tables Without Dance Floor, Without Stage  =  200.

Tables and Stage, Without Dance Floor  = 170.

Veranda  -  4 round tables with 10 chairs at each.

Setup forms can be found in the rotary rack outside of the RSC’s office.

The ballroom will be set up cabaret-style.  You’ll be able to BYOB&F.   Bring whatever you want to eat and drink.  The Men’s Club will supply table ware, napkins, cups, bottled water & coffee.

 

Each table will seat 10 people.  Cost is just $5.00pp for 2019 Men’s Club members.  If submitting a group table reservation please place all checks in 1 (one) envelope.  Tables will be combined if under 10.  Individual/couple checks will also be accepted and then table-assigned.

 

The Men’s Club makes every effort to accommodate any resident MC member wishing to attend our events.  However, payment of membership dues does not guarantee admission to an event because of capacity limitations.

WINE  CLUB 

 

Our first wine tasting of the new year will be held on Tuesday, January 22nd.  

 

Our focus this month will be on wines from the J. Lohr Vineyards in San Jose California. Committee members Joyce DeSiena and Bob Skeele selected the 4 White wines and 4 Red wines we will sample.  The wines range in price from $10.99 to $25.99.  Our Speaker will be James Wallace, Regional Manager for J. Lohr and he will give us lots of details on the wines and the vineyards.

 

We will follow our usual format for the evening.  Enter through the Lobby to the Veranda where you will pick up your name badges and raffle ticket.  Tables will be set for places of 8 each and there is no assigned seating for this tasting.  Please do remember to bring your WINE GLASSES with you to this tasting.  Wine tastes so much better in a glass than in a plastic cup!  New members will receive their wine glasses at the first wine tasting they attend. Doors will open at 6:45 PM and we will start the evening event at 7 PM.  

 

The cost will be $20 per person, and checks should be made payable to FSML  - Wine Club with the notation  “January”  in the memo line and placed in the Wine Club lockbox #27 no later than Thursday January 17h PLEASE.  This insures we have enough food and places set for everyone attending.
